RTI activists miffed at Wakf Board

Hyderabad: The AP State Wakf Board has come under fire from RTI activists for ignoring queries requesting information on its properties. The board does not disclose requisite information even after long delays and gets away with it as the Information Commission goes easy on them, the activists alleged on Friday.
    A case in point is an RTI application that was filed by a city-based activist on August 17, 2010, requesting information through 16 questions on number of wakf properties in Hyderabad and Ranga Reddy districts, the number of tenants the board has, the revenue generation and its use, selection of tenants, procedure for fixing rents, amount due to the board, and other issues related to the protection and maintenance of wakf properties.
    The board turned down the request replying that the information sought cannot be furnished under RTI Act. Even after appealing to the first appellant authority in the board, the information was not provided. After the applicant moved the commission and after two hearings, the board in October last furnished replies to a few questions while the others were ignored stating that information has to be gathered. But it failed to give a count of the number of buildings under its possession as demanded by the applicant.
    In November last week, the board had furnished replies to two more questions pertaining to annual income-expenditure on its buildings and the maintenance costs on them. However, the board in its recent reply stated that the count of the number of buildings is not with the accounts section but may be available with other sections.
    Activists working for protection of wakf properties allege that the board does not disclose updated information even if the petitioner appeals to the commission. “The information provided is often outdated and is not complete besides the delay in furnishing information even if it goes for hearing in the commission. If the commission is strict with the board, the board will become more responsive to RTI queries,” said an activist.
    The board made its displeasure about RTI activists clear when it passed a resolution in 2010 baring entry to a few individuals who were constantly seeking information under the Act.

अगस्त 2008 में मैंने ग्रेटर हैदराबाद नगर निगम (GHMC) में इस्तेमाल होने वाले वाहनों का विवरण आरटीआई दाख़िल कर मांगी थी. उर्दू में दिए गए आवेदन का जीएचएमसी ने अंग्रेजी में जवाब दिया. इस मामले में मैंने सूचना आयोग का रुख नहीं क्या. क्योंकि अंग्रेजी में ही सही, सूचना हासिल कर मुझे खुशी हुई थी.

दिसम्बर 2008 में मुख्य सूचना आयुक्त वज़ाहत हबीबुल्लाह से एक प्रेस कांफ्रेस में मुलाकात का मौका मिला. इस प्रेस कांफ्रेस में छोटी सी मुलाक़ात के दौरान मैं वज़ाहत हबीबुल्लाह से जानना चाहा कि उर्दू भाषा में दाखिल की गई आरटीआई का जवाब अंग्रेजी में दिया जा सकता है क्या? जवाब में  वज़ाहत हबीबुल्लाह ने कहा कि किसी भी सरकारी भाषा में आरटीआई के तहत आवेदन दाखिल किया जा सकता है और उन्हें उसी भाषा में जानकारी प्राप्त करने का अधिकार हासिल है.

इस के बाद 18 जनवरी 2008 को मैंने जिला कलेक्टर हैदराबाद को आरटीआई के तहत एक आवेदन दिया. इस आरटीआई द्वारा मैंने  उर्दू व तेलगू मीडियम के सरकारी स्कूल के बारे में विवरण मांगा था. जिला कलेक्टर ने जिला शिक्षा अधिकारी को सूचना देने का निर्देश दिया. लेकिन जिला शिक्षा अधिकारी ने उर्दू भाषा में दिए गए आरटीआई का जवाब देना ज़रूरी नहीं समझा.

एक महीने बाद मैंने पहली अपील की. लेकिन मेरी पहली अपील का जवाब नहीं मिला. जिसके बाद 24 मार्च 2008 को मैंने आंध्र प्रदेश सूचना आयोग को अपनी द्वितीय अपील दर्ज कराई. उसके बाद एक मई 2008 को आंध्र प्रदेश सूचना आयोग ने जिला शिक्षा अधिकारी, हैदराबाद और मुझको नोटिस जारी करते हुए 15 मई को आयोग के समक्ष पेश होने का निर्देश दिया. जिसके बाद शिक्षा विभाग के अधिकारी हरकत में आ गए. 6 मई के दिन मुझे 28 अप्रैल का लिखा पत्र रवाना करते हुए शिक्षा विभाग ने कहा कि मेरी आरटीआई का जवाब अंग्रेजी में दिया जाएगा. अगर मुझे उर्दू भाषा में सूचना चाहिए तो मुझे अंग्रेजी से उर्दू अनुवाद पर होने वाले खर्च यानी 1800 रुपये चुकाने होंगे. मैंने शिक्षा विभाग के इस पत्र का जवाब नहीं दिया. बल्कि सूचना आयोग के सुनवाई का इंतजार किया.

15 मई को राज्य सूचना आयोग ने मेरे मामले की सुनवाई की. आयोग ने मुझसे सवाल किया कि मुझे उर्दू भाषा में जानकारी क्यों चाहिए? जिस पर मैंने जवाब दिया कि उर्दू मध्यम से ग्रेजुएशन कर रहा हूं और उर्दू अख़बार का रिपोर्टर हूं. अंग्रेजी में सूचना प्राप्त करके मैं  सूचना का उपयोग नहीं कर सकता. मेरे इस बात पर आयोग ने जिला शिक्षा अधिकारी को फटकार लगाई और 25 मई 2008 तक मुझे उर्दू भाषा में सूचना उपलब्ध  कराने का निर्देश दिया. जिसके बाद शिक्षा विभाग के अधिकारियों ने 25 मई को शाम 4 बजकर 50 मिनट पर रोज़नामा राष्ट्रीय सहारा, हैदराबाद के दफ़्तर में मुझसे मुलाकात की. और समस्त सूचना मुझे उर्दू भाषा में उपलब्ध कराई. जिसके बाद मैंने इस सूचना को किस्त-वार रोज़नामा राष्ट्रीय सहारा में प्रकाशित कराया.

17 अगस्त 2010 को मैंने आंध्र-प्रदेश राज्य वक्फ बोर्ड में आरटीआई के तहत उर्दू भाषा मों एक आरटीआई दाखिल कर वक्फ बोर्ड के भवनों से संबंधित सूचना मांगा कि वक्फ बोर्ड की हैदराबाद और रंगारीडी जिलों में कितनी इमारतें हैं? इन इमारतों से कितनी आमदनी बोर्ड को प्राप्त होती है? इमारतों से प्राप्त आमदनी कहां खर्च किया जाता है? आदि-अनादि…

लेकिन वक्फ बोर्ड ने मुझे कोई सूचना नहीं दिया. 25 सितंबर 2010 को मैंने पहली अपील कर दी. अपील के बाद आंध्र प्रदेश वक्फ बोर्ड ने 8 अक्तूबर 2010 को मुझे एक पत्र भेज कर सूचित किया कि मेरी उर्दू अनुरोध को अस्पष्ट क़रार देते हुए खारिज किया जाता है. इसके बाद मैंने 18 अक्तूबर को आंध्र प्रदेश सूचना आयोग में दूसरी अपील दाखिल की. जिस पर आयोग ने दो वर्ष बाद 6 अगस्त को 2012 को सुनवाई की. सुनवाई के बाद आयोग ने आंध्र प्रदेश वक्फ बोर्ड को निर्देश दिया कि आवेदक को दस दिनों के भीतर जवाब दिया जाए और आवेदक को मुआवजा भी अदा किया जाए. लेकिन वक्फ बोर्ड को इससे कोई फर्क नहीं पड़ा.

आयोग ने फिर से वक्फ बोर्ड को नोटिस जारी करके  बोर्ड के अधिकारियों को 7 सितम्बर को आयोग  के समक्ष हाज़िर होने का निर्देश दिया. लेकिन बोर्ड के अधिकारी 7 सितम्बर को आयोग के समक्ष उपस्थित नहीं हुएं. जिसके बाद आयोग ने सुनवाई को 5 अक्टूबर 2012 तक स्थगित कर दिया.

4 अक्टूबर 2012 को यानी सुनवाई से एक दिन पहले आंध्र प्रदेश राज्य वक्फ बोर्ड के अधिकारियों ने मुझे जानकारी का एक नाटक रचा. वक्फ बोर्ड के अधिकारियों ने 5 पृष्ठों का दस्तावेज मुझे उपलब्ध कराया. इन दस्तावेजों में मेरे प्रश्न के जवाब में बताया कि आंध्र प्रदेश वक्फ बोर्ड के पास हैदराबाद और रंगारीडी में मौजूद वक्फ इमारतों की जानकारी वक्फ बोर्ड के सर्वेक्षण रिकॉर्ड में उपलब्ध नहीं है. इसलिए सूचना देने में आंध्र प्रदेश वक्फ बोर्ड असमर्थ है. साथ ही जन सूचना अधिकारी ने यह भी बताया कि मैंने जो सूचना मांगी है, वह विभिन्न क्षेत्रों से मांगी गई है और अपने ही विभिन्न क्षेत्रों से जानने के लिए आंध्र प्रदेश वक्फ बोर्ड को 2 साल से अधिक समय लग गया. दरअसल, यह मुझे गुमराह करने की कोशिश है.

इसके बाद 5 अक्टूबर 2012 को मैंने आंध्र प्रदेश सूचना आयोग में एक और अपील दायर की. इस अपील में कहा कि आंध्र प्रदेश वक्फ बोर्ड अधूरी सूचना उपलब्ध करा कर आंध्र प्रदेश सूचना आयोग और आवेदक दोनों को गुमराह करने की कोशिश कर रहा है. लेकिन अफसोस! सूचना आयोग ने अब तक मेरी इस अपील पर सुनवाई की तारिख तय नहीं की है.

वक्फ बोर्ड के इस मामले पर 9 सितम्बर और 7 अक्टूबर 2012 को दो बार टाइम्स ऑफ इंडिया, हैदराबाद में रिपोर्ट प्रकाशित हुई है. इसके अलावा रोज़नामा राष्ट्रीय सहारा हैदराबाद में भी उन्हें दो तारीखों में रिपोर्ट प्रकाशित हुई है. 16 सितम्बर 2012 को रोज़नामा एतमाद संडे संस्करण में एक लेख भी प्रकाशित किया गया है, जिनमें मेरी इन प्रयासों का अच्छा वर्णन है.

बहरहाल, आरटीआई कानून को पारित हुए 7 साल हो गए हैं और मैं 4 साल से आरटीआई कानून का प्रयोग करता आ रहा हूं. लेकिन मेरा व्यक्तिगत विचार है कि आंध्र प्रदेश सूचना आयोग सुनवाई के दौरान सरकारी विभागों और अधिकारियों की तरफदारी करता है. यही नहीं,  सरकार ने लगभग दो साल तक सूचना आयुक्त के पदों को खाली रखा. लेकिन दो साल बाद 4 कमिश्नरों की नियुक्ति की गई है. सूचना आयोग ने 7 सालों में जानकारी देने से परहेज करने वाले अधिकारियों के खिलाफ केवल कारण बताओ नोटिसें ही जारी की हैं जुर्माने शायद ही किसी अधिकारी पर लगाया है.

अगर आयोग अधिकारियों और सरकारी विभागों से सख्ती से पेश आए और अनुशासनात्मक कार्रवाई करे तो आरटीआई कानून और भी प्रभावी हो सकता है. यह कितना अजीब है  कि आरटीआई के एक आवेदन दाखिल करने के दो वर्ष बाद भी मुझे अब तक मांगी गई सूचना उपलब्ध नहीं हो सकी है और आयोग न तो सूचना दिलवा पा रही है और न ही इन दोषी अधिकारियों पर जुर्माना.

आयोग के पास दोषी सरकारी अधिकारियों के खिलाफ गिरफ्तारी का वारंट जारी करने का भी अधिकार दिया जाना चाहिए, क्योंकि सूचना आयोग की नोटिसें प्राप्त होना और आरटीआई का जवाब न देना, सरकारी अधिकारियों की आदत बन चुकी है. दूसरी ओर आरटीआई कार्यकर्ताओं की सुरक्षा के लिए भी क़दम उठाए जाने चाहिए. क्योंकि विभिन्न विभागों में हो रहे भ्रष्टाचार दरअसल राजनीतिक लीडरों की नेतृत्व के बाद ही संभव हो पाता है और भ्रष्टाचार से प्राप्त की गई रिश्वत कई लोगों में विभाजित होती है. इसलिए रिश्वत से सहायता लेने वाले भ्रष्टाचार का पर्दाफाश करने वाले आरटीआई कार्यकर्ताओं को निशाना बनाने से बाज नहीं आते हैं. आरटीआई कार्यकर्ता सिर्फ अकेला और मुक़ाबले में कई भ्रष्ट लोगों खड़े नज़र आते हैं. इसलिए आरटीआई कार्यकर्ताओं की सुरक्षा सुनिश्चित करने के लिए सरकार को क़दम उठाने चाहिए ताकि आरटीआई कानून के उपयोग से भ्रष्टाचार उन्मूलन को संभव बनाया जा सके.

Wakf board mum on RTI queries

Hyderabad: Failing to respond adequately to a two-year old RTI query, the state wakf board has yet again displayed its inability to keep track of its properties, a good percentage of which are under encroachment. 

TOI had reported on September 9 about the filing of an RTI query with 16 questions in August 2010 by a city journalist Mirzaghani Baig seeking informa

tion about wakf properties in the Hyderabad and Rangareddy districts and their management. After the board failed to provide information, the applicant moved the AP Information Commission. The commission reprimanded the board in an order passed on August 18 directing it to furnish information within 10 days. It then had also directed the board to pay compensation to the applicant.
The board instead sought to dither by stating the information is to be obtained from different sections. For instance, the board could not give information on the number of wakf buildings in the two districts nor could it give the number of tenants in its buildings. The last hearing on the case was held on October 5 where the compensation amount was to be fixed. The applicant rued that even the replies that were given were not satisfactory. In his complaint to the Chief Information Commissioner, he stated that the wakf board is misguiding the commission and the applicant.

Wakf Board denies info, fined

HYDERABAD: Yet another incident in the endless saga of incompetence involving wakf properties, the State Wakf Board may have to shell out as much as Rs 25,000 for having refused to provide information on its properties in Hyderabad and Ranga Reddy district that was demanded through an RTI application filed two years ago.

The application was filed by city based scribe and RTI activist Mirza Ghani Baig on August 17 2010. His questions pertained to number of wakf properties in the two districts, the number of tenants the board has, the revenue generation and its use, selection of tenants, procedure for fixing rents, amount due to the board, and other issues related to the protection and maintenance of wakf properties. The board turned down the request replying that the information sought cannot be furnished under RTI Act. Even after appealing to the first appellant authority in the board, the information was not provided.
The applicant then moved the AP Information Commission which directed the Wakf Board to appear on August 6 this year. The board through its Assistant Public Information Officer informed the commission that information cannot be provided as the request was "not specific" for furnishing under RTI.
The commission reprimanded the board by saying that its stand was not correct and issued a show cause notice in addition to ordering payment of compensation to the appellant. A hearing was scheduled for September 7 for fixing the compensation amount but was adjourned as the board sought more time to present its stand. The applicant Baig said his objective was to bring in public domain the losses the board was incurring as the nominal rents from its properties have not been revised. tnn. "Properties in prime locations like Pathargatti where the rent for commercial space is more than Rs 10,000 are being leased for a few hundred rupees. Near Moazzam Jahi market a national bank which occupies one of the wakf properties is also paying meager rent. Many have even defaulted in payment of nominal rent. If the board gets its act in order this will benefit the community," he claimed.

HPCL 250 Graduate Engineers Recruitment through GATE 2013

HPCL invites bright and dynamic Engineering Graduates, in specified disciplines aspiring to join it‟s team of world class professionals for making career in its marketing division. Interested candidates are required to appear for GATE 2013,for their respective discipline.

Age Limit:Maximum 25 years as on 30th June 2013 for the general category candidates. Age relaxation for OBC (Non Creamy Layer)/SC/ST/PWD candidates will be applicable as per the Presidential Directive.
Educational Qualification:
1.Candidates should have passed qualifying degree examinations and awarded bachelor‟s degree in engineering/technology in the above mentioned disciplines (full time regular courses only) from recognized Indian Universities/ Institutes.
2.Candidates (belonging to General and OBC-NC category) should have secured minimum 60% marks in qualifying degree examinations. It is relaxed to 50% for SC/ST/PWD candidates.
3.Candidates currently in final year of their engineering studies may also apply. However, if selected, they must be in a position to submit their final mark sheet by 31st August 2013.At the time of applying Candidates (belonging to General and OBC-NC category) should have secured minimum 60% aggregate marks upto last semester examinations. It is relaxed to 50% for SC/ST/PWD candidates.
Selection Process:
Graduate Aptitude Test in Engineering (GATE) 2013 score of the candidates in the concerned disciplines.The graduate engineers from the relevant disciplines,desirous of taking up a career with Hindustan Petroleum are required to appear in GATE-2013
1.On the basis of GATE-2013 score/marks, the candidates will be short listed for further selection process comprising of:
2.Group Discussion/Group Task and or Personal Interview for assessment of different facets of knowledge, skill, attitude and aptitude.
3.Please note that only GATE-2013 score is valid for this recruitment exercise. GATE score of 2012 or prior to that is not valid.
Application Fee:A Non-refundable amount of Rs.200 + applicable Banking charges towards processing fee is required to be paid by General & OBC-NC candidates while applying for HPCL.The detail modalities of Payment procedure will be advised in due course. No Processing fee is applicable for SC/ST & PWD candidates.
How To Apply:The candidates will receive their GATE-2013 Registration number printed on their admit card.On receipt of GATE registration number, the candidates need to apply to Hindustan Petroleum on-line. Junior Civil Judge Recruitment in High Court of Andhra Pradesh, Hyderabad

For appointment to the posts of Civil Judge (Junior Division)

Applications are invited for the posts of Civil Judges (Junior Division) under AP State Judicial Service :

• Junior Civil Judge : 69 posts(General Recruitment  – 40 and Backlog vacancy – 29), Qualification : Must be a holder of a degree in Law awarded by any University established by Law in India, Age : 35 years as on 01/02/2011 and 48 years for recruitment by transfer.

Fee : a crossed demand draft for Rs.100/- in favour of the Registrar (Recruitment), High Court of Andhra Pradesh, Hyderabad payable at Hyderabad. SC/ST candidates are exmpted from fee.
